The basmaPartners shall be under
no liability whatsoever in respect of any loss or damage arising
directly or indirectly out of:
the basmaPartners or any Merchant
Partner refusing to allow a basma Transaction or refusing to
accept the basmaCard or the PIN,
malfunction of any POS Terminal or
other equipment employed in providing infrastructure for the basmaProgramme,
the exercise by the basmaPartners
of their right to demand the surrender of the basmaCard and / or
to suspend or terminate the basmaCard,
the exercise by the basmaPartners
of their right to terminate the basmaProgramme,
any dispute
between You and any Merchant Partner or any third party.
Without prejudice to the
provisions of Clause 10.1, the basmaPartners accept no
responsibility or liability whatsoever for any direct, indirect
or consequential loss, damage, costs or otherwise arising from
the use of the basmaCard or from participation in the
basmaProgramme. If the basmaPartners or any Merchant Partner or
any employee or agent of a basmaPartner and / or a Merchant
Partner is found liable under Law for any damage or loss, the
liability of the basmaPartner(s) or Merchant Partner(s) as the
case may be shall be limited to the maximum extent permissible
by Law.
